These Terms and Conditions govern the use of the LivingSpot real estate platform ("LivingSpot", "Platform", "Service"), including the placement, management, and publication of real estate advertisements.

The platform is operated by LivingSpot ("Operator", "we", "us", "our"). By using the Platform, users agree to comply with these Terms and Conditions.

LivingSpot provides an online real estate marketplace and AI-powered property discovery platform connecting property owners, buyers, renters, developers, and real estate professionals.

The Operator reserves the right to monitor platform activity and enforce these Terms where necessary.

LivingSpot enables users to:

• Publish and manage real estate listings;

• Search, filter, and discover properties;

• Use AI-powered property recommendations and search tools;

• Communicate with property owners, brokers, or agencies;

• Access analytics, property insights, and market data;

• Promote listings using premium placement services.

Listings may be uploaded manually or through supported API/import integrations. The Operator reserves the right to determine how listings are displayed, ranked, filtered, recommended, or promoted across the Platform.

The Platform may be used by:

• Licensed real estate brokers and agencies;

• Property developers;

• Property owners;

• Companies offering real estate-related services;

• Registered users searching for real estate.

Users must provide accurate registration and identification information. The Operator may request verification documents including:

• Business registration certificates;

• Real estate licenses;

• Proof of ownership;

• Brokerage agreements;

• Identity verification documents.

Users are responsible for maintaining the confidentiality and security of their account credentials. Sharing accounts between unrelated businesses or individuals is prohibited.

Users may only advertise properties that:

• They own;

• They are legally authorized to market;

• They actively manage or broker.

The following activities are prohibited:

• Duplicate or misleading listings;

• Publishing fake or unavailable properties;

• Artificial manipulation of listing rankings;

• Unauthorized reposting of third-party advertisements;

• Publishing inaccurate pricing or property data;

• Using automated scraping or unauthorized data extraction tools.

The Operator reserves the right to remove listings or suspend accounts that violate these Terms.

LivingSpot may use artificial intelligence systems to:

• Recommend listings to users;

• Rank or personalize search results;

• Generate listing descriptions;

• Detect fraud, spam, or policy violations;

• Classify images and property attributes.

AI-generated outputs are provided for informational purposes only and may not always be accurate. Users remain fully responsible for verifying all property information before publication. The Operator does not guarantee the accuracy, completeness, or suitability of AI-generated recommendations.

To use advertising features, users must create a verified account. The Operator may require:

• Email verification;

• Phone verification;

• Identity verification;

• Business verification.

Users are responsible for all activity performed through their accounts. If unauthorized access is suspected, users must immediately notify the Operator.

Each property listing must:

• Represent a real and currently available property;

• Contain accurate and truthful information;

• Include a valid price;

• Include genuine photographs of the property;

• Be categorized correctly.

Only one active listing per property is allowed unless the property is offered for both sale and rent, or the property legitimately belongs in multiple categories.

Listings must not contain:

• False or misleading claims;

• Offensive or illegal content;

• External links to competing marketplaces;

• Spam or excessive capitalization;

• Watermarks or advertising overlays obstructing photos;

• Copyright-infringing content.

The Operator may edit, reject, suspend, or remove listings that violate these Terms.

Users may upload photos, floorplans, videos, and virtual tours. Uploaded media must:

• Belong to the advertiser or be properly licensed;

• Accurately represent the property;

• Not infringe third-party rights;

• Not contain misleading visual edits.

The Operator may use automated systems to classify and organize uploaded media. The Operator reserves the right to remove media that violates platform standards.

LivingSpot may offer paid promotional services including:

• Featured listings;

• Priority placement;

• Regional promotion;

• AI-enhanced exposure;

• Sponsored visibility.

Premium placement does not guarantee sales, inquiries, or transaction completion. The Operator reserves the right to modify promotional algorithms and visibility systems.

Advertising services may be charged through:

• Subscription plans;

• Pay-per-listing pricing;

• Promotional packages;

• Credit-based systems.

All fees are displayed on the Platform or agreed individually. Payments are generally non-refundable unless required by applicable law.

Failure to pay may result in:

• Suspension of listings;

• Account restrictions;

• Termination of access.

The Operator reserves the right to change pricing with prior notice.

Users are solely responsible for:

• Listing content;

• Property accuracy;

• Legal compliance;

• Communications with buyers or tenants;

• Contracts and transactions.

The Operator is not a party to property transactions and does not guarantee:

• Property ownership;

• Property condition;

• Transaction completion;

• Payment security.

Users must comply with all applicable laws and regulations.

All platform content, software, branding, design, databases, and technology belong to LivingSpot or its licensors.

Users retain ownership of their uploaded content but grant the Operator a worldwide, non-exclusive, royalty-free license to:

• Display;

• Distribute;

• Promote;

• Modify for formatting purposes;

• Use for platform operations and marketing.

This license continues for archived or cached content even after listing removal. Unauthorized scraping, copying, or commercial reuse of Platform data is prohibited.

LivingSpot processes personal data in accordance with applicable privacy and data protection laws, including GDPR where applicable. Detailed information is available in the Privacy Policy.

The Operator may:

• Review listings manually or automatically;

• Remove content;

• Suspend accounts;

• Limit platform access;

• Request supporting documentation.

Enforcement actions may occur without prior notice in cases involving fraud, illegal content, security risks, or repeated violations. Users may contact support regarding moderation decisions.

The Platform is provided "as is" and "as available". The Operator does not guarantee:

• Continuous availability;

• Error-free operation;

• Accuracy of listings;

• Compatibility with third-party systems.

To the maximum extent permitted by law, the Operator is not liable for indirect damages, lost profits, business interruption, user disputes, or property transaction outcomes.

Users may terminate their account at any time. The Operator may suspend or terminate accounts that:

• Violate these Terms;

• Engage in fraud or abuse;

• Fail to pay fees;

• Harm the Platform or other users.

The Operator may retain archived data where required by law or legitimate business purposes.

The Operator reserves the right to update these Terms. Material changes will be communicated through email notifications, platform notifications, and updated publication dates. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted under the laws applicable in the jurisdiction where the Operator is established. Any disputes shall be resolved by the competent courts of that jurisdiction unless otherwise required by consumer protection laws.
